Terms of Use

These terms are the agreement between you and Everlasting Confidence ("we", "us") for the ColdApproach.AI app and this website. By making an account or using the app, you agree to them. If you do not agree, please do not use the app.
1. Who can use the app
You must be 18 or older. By using the app you confirm that you are. You must also be able to enter a binding agreement where you live.
2. The subscription and the free trial
- ColdApproach.AI is a paid subscription: $97 a month or $849 a year.
- Both plans start with a 3-day free trial. If you cancel at least 24 hours before the trial ends, you are not charged. If you do not cancel, the plan you chose starts when the trial ends and you are charged.
- During the 3-day trial you can ask the coach up to 5 questions and record 1 approach review. The full monthly allowance (100 questions and 50 reviews) starts when the paid plan begins.
- The subscription renews automatically at the end of each period (monthly or yearly) until you cancel.
- Subscriptions are bought, managed, and cancelled through the App Store or Google Play, not through us. To stop future charges, cancel in the store at least 24 hours before the current period ends. The support page has the steps.
- We cannot issue refunds. Payment is handled by Apple or Google, and their refund rules apply. Ask the store you bought from.
- Prices are shown in the store in your local currency and may change. If they change, the store will tell you before you are charged the new price.
3. The monthly allowance
- Each month your subscription includes 100 questions to the coach and 50 approach reviews.
- The allowance resets on the first of the month.
- Unused questions and reviews do not roll over to the next month.
4. What the app is, and what it is not
ColdApproach.AI is AI coaching in the voice of a real coach, Daniel Jacob. The replies are written by an AI model and spoken with a cloned voice. They are not written or reviewed by Daniel Jacob in real time.
The app is educational. It is not therapy, medical advice, legal advice, or any other professional advice, and it is not a substitute for any of those. The AI can be wrong. Use your own judgment, respect the people around you, and never do anything that makes someone else feel unsafe or unwelcome. If you are in crisis, contact local emergency services or a licensed professional.
5. Recording and local laws
During an approach, the app listens through your phone and turns what it hears into text on the device. Audio is never saved and never leaves the phone. Even so, laws about recording or transcribing conversations differ from place to place, and some places require the consent of everyone involved.
You are responsible for knowing and following the laws where you are. You must not use the approach feature where consent rules forbid it, and you must stop using it if anyone asks you to. We are not responsible for how you use the app in your location.
6. Acceptable use
You agree not to:
- Use the app to harass, stalk, pressure, or deceive anyone, or to approach someone against their wishes.
- Use the app in a way that breaks the law or violates someone else's rights.
- Copy, sell, rent, or share your account or the coach's replies as a product.
- Reverse engineer, decompile, scrape, or try to extract the app's code, prompts, or the cloned voice.
- Try to get around the monthly allowance, the subscription, or any security measure.
- Upload anything harmful, or try to make the AI produce content that is abusive or illegal.
7. Your account
You sign in with Apple, Google, or an emailed code. Keep your sign-in method secure. You are responsible for what happens under your account. Tell us right away at support@coldapproach.ai if you think someone else has used it. One account is for one person.
8. Your content and ours
What you say to the coach and your approach transcripts are yours. You give us permission to store and process them so the app can work, as described in the Privacy Policy. The app, its design, the coach's replies, and the cloned voice belong to us and our licensors. You may use the replies for your own personal learning.
9. Ending the agreement
You can stop using the app at any time. To stop billing, cancel in the App Store or Google Play. To delete your account and data, email support@coldapproach.ai.
We can suspend or close your account if you break these terms, if we are required to by law, or if we shut the service down. If we close your account for breaking these terms, you are not owed a refund.
10. Changes to the app and to these terms
We may change or remove features, and we may update these terms. If we make a significant change to the terms, we will post the new version here with a new effective date and tell you in the app or by email. Using the app after a change means you accept the new terms.
11. No warranty
The app is provided as it is. We do not promise that it will always be available, free of errors, or right for your situation, and we do not promise any particular result in your dating life. The coach's replies are generated by an AI and can be wrong or incomplete.
12. Limitation of liability
To the extent the law allows, we are not liable for indirect, incidental, or consequential losses, or for anything that happens because of how you use the app or act on its advice. If we are found liable for anything connected to the app, our total liability is limited to the amount you paid for your ColdApproach.AI subscription, through the App Store or Google Play, in the 12 months before the claim. Some places do not allow these limits, so some of them may not apply to you.
13. Governing law
These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be handled in the state or federal courts located in California, and you agree to that jurisdiction. If a court finds part of these terms unenforceable, the rest still applies.
